Kyle T Young ("kyletyoung" or "kty") operates kyletyoung.com, which is a relatively unimportant website on the internet but now thanks to the Lori Drew verdict, now has federal power over its visitors.
This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the Kyle T Young website. By using the Kyle T Young website, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse the Kyle T Young without being registered) or you are a "Member" (which means that you have registered with Kyle T Young). Please read this Agreement and save it.
Kyle T Young may modify this Agreement from time to time and such modification shall be effective upon posting by Kyle T Young on the Kyle T Young Website. Your continued use of the Kyle T Young website after Kyle T Young posts a revised Agreement signifies your acceptance of the revised Agreement. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes. Seriously, this thing can change like 10 times a day because I've got bad grammar.
1. Eligibility. Use of the Kyle T Young website and registration to be a Member for the Kyle T Young website ("Membership") is void where prohibited (some parts of Canada). By using the Kyle T Young website, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; and (d) your use of the Kyle T Young website does not violate any applicable law or regulation. Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are under 13 years of age, if we believe that you are under 18 years of age and you represent yourself as 18 or older, or if we believe you are over 18 and represent yourself as under 18, or if we believe that you are under 13 years of age but have drawn a clever mustache on all your photos to disguise yourself as a 29 year old man who calls himself "David".
2. Term. This Agreement, and any posted revision to this Agreement, shall remain in full force and effect while you use the Kyle T Young website or are a Member. Kyle T Young may and probably will terminate your Membership at any time, for any or no reason, with or without prior notice or explanation, without liability, and even sometimes without realizing it.
3. Fees. Each connection to the Kyle T Young website (including your current connection while reading these terms) requires the visitor (You!) to pay the Kyle T Young website US$1.00. The Kyle T Young website has deemed this a fair amount to recover its own operation and connection costs. You, the visitor, are required to pay in full your fees to the Kyle T Young website at your convenience but your fees must be paid in full before the Lori Drew verdict is overturned.
4. Proprietary Rights in Content on Kyle T Young. The Kyle T Young website claims ownership of everything, real or imaginary.
5. Protecting Copyrights and Other Intellectual Property. Kyle T Young does not respect the intellectual property of others, and requires that our users do the same. You must upload, embed, post, email, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person or entity. Kyle T Young has the right to terminate the Membership of non-infringers.
If you believe your work has been copied and posted on or through the Kyle T Young website in a way that constitutes copyright infringement, please stop whining and just be happy you made something that people actually find interesting enough to copy.
6. Privacy. Any information given to the Kyle T Young website will remain private until the information is compromised in which your information will not be private.
7. Disclaimers. Kyle T Young is not responsible for and makes no warranties, express or implied, as to the User Content or the accuracy and reliability of the User Content posted on or through the Kyle T Young website, whether caused by Users of the Kyle T Young website or by any of the equipment or programming associated with or utilized in the Kyle T Young website and such User Content does not necessarily reflect the opinions or policies of Kyle T Young. In other words, we hold you responsible for everything and hold ourselves irresponsible and responsible for nothing.
8. Limitation on Liability. IN NO EVENT SHALL KYLE T YOUNG BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE KYLE T YOUNG WEBSITE, EVEN IF KYLE T YOUNG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, KYLE T YOUNGS LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO KYLE T YOUNG FOR THE KYLE T YOUNG WEBSITE DURING THE TERM OF MEMBERSHIP. THIS IS IMPORTANT THAT IS WHY IT IS IN CAPSLOCK.
9. Indemnity. You agree to indemnify and hold Kyle T Young, its subsidiaries, and affiliates, and their respective officers, agents, partners, dudes, employees and friends, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Kyle T Young website in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth in this Agreement and/or if any Content that you post on or through the Kyle T Young website causes Kyle T Young to be liable to another. Kyle T Young doesn't understand this paragraph either but you must abide by it.
10. Other. That's about it. Just be cool and follow the Kyle T Young terms and you won't go to federal prison and pay $100,000 per violation in fines.
